PROMOTER

The 3 Legged Thing Try Before You Buy Promotion (hereafter referred to as the "Promotion") is promoted by 3 Legged Thing Limited of Unit 2A Kinsbourne Farm, Bury End, Stagsden, Bedfordshire. MK43 8TS(the "Promoter").

 

ELIGIBILITY

The Promotion is applicable to residents of the following countries: Great Britain (“Participating Countries”).

The participant must be at least 18 years old (“Participant”). Employees of the Promoter, its subsidiary companies, their families, agents and other parties directly involved with this Promotion are not eligible to enter. The Promotion is only open to Participants purchasing for their own use i.e., end users. The Promoter reserves the right to verify the eligibility of Participants and/or to exclude Participants at its sole discretion at any time for any reason. Resellers may not submit claims on behalf of their customers.

To participate in the Promotion, Participants will need to create an account with TrytheKit https://3leggedthing.trythekit.com and hire a Promotional Product for a minimum of 48 hours (2 days). If the Participant wants to hire the Promotional Product for longer than 48 hours, the first 48 hours only will be reimbursed, and any additional period will be chargeable at the normal rate in accordance with TrytheKit's Terms of Use.

Participants will be required to pay a Hire fee, delivery charges, and a refundable security deposit. Such registration and hire will be subject to TrytheKit’s Terms of Use and Privacy Policy and 3 Legged Thing accepts no liability in respect of your use of TrytheKit services.

3 Legged Thing Limited of Unit 2A Kinsbourne Farm, Bury End, Stagsden, Bedfordshire. MK43 8TS is the Promoter of this promotion. TrytheKit of Unit 5, Wellbrook Farm, Berkeley Road, Mayfield, East Sussex, TN20 6EH is administering the promotion to Participants via their TrytheKit account.

Orders must be placed before 2pm to ensure next day delivery. Any hire made for a Saturday or Sunday will be delivered Friday and collected on Monday. Deliveries and collections are not available on weekends and UK public holidays.

Delivery within the usual timescales above cannot be guaranteed to remote locations, and next day delivery cannot be provided due to limited courier availability in some areas.  Items may take up to 48hrs to deliver but where reasonably possible we will endeavour to move the dispatch date forward.

Due to the current Brexit complications, we are currently unable to service Northern Ireland and non-mainland British Isles. We are continuing to review this and will resume operations as soon as it is possible to offer a reliable service.

TrytheKit will not process any hire requests received after the closing date of 23:59 on Sunday 31stDecember 2022. TrytheKit will not process a hire request which is in its opinion incomplete. TrytheKit and 3 Legged Thing will not be responsible for any hired product delayed or not successfully received.

The Participant has to purchase a qualifying Tripod (“Qualifying Products”), as described in Annex 1, from a 3LeggedThing.com in the period from 31/03/2023 to 31/12/2023 (“Promotion Period”) and register the Qualifying Products in accordance with these terms and conditions.

All Qualifying Products must be new and genuine 3 Legged Thing products. Purchases of second hand, refurbished or reconditioned products, and products imported from outside the Participating Countries or products which are counterfeit or infringe the intellectual property rights of the 3 Legged Thing in any way will not qualify for this Promotion.

This promotion is only open to people who have completed a loan for any 3 Legged Thing product from TrytheKit.com, the product loaned does not need to be the same as the product purchased as part of this promotion.

 

CASHBACK

When participating in this Promotion the Participant will get a pay-out of Cash Back in the amount according to the table in Annex 1 (“Cash Back”) subject to these terms and conditions and return of the hired product to TrytheKit in accordance with TrytheKit terms and conditions. 

The Cash Back offered under this Promotion is non-exchangeable, non-transferable and there is no cash or credit alternative available.

A maximum of 5 Qualifying Products can be claimed per Participant, during the Promotion. Only 1 claim may be made per Qualifying Hire.

To claim the Cash Back the Participant must provide the following mandatory information within 60 days of the Hire order closing, to the email address enquires@TrytheKit.com

 

1) Personal Details (Title, full name, postal address, country of residence, e-mail address)

2) Product Details (Product, store name, date of purchase, serial number, uploaded scan of the invoice)

3) Bank Details

 

Claims relating to Qualifying Products purchased before or after the Promotion Period will be deemed invalid.

The Participant should ensure the purchase receipt includes the product name (model number) purchased, store name and the date of purchase.

The Promoter will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the Participant from or otherwise obstructs the Participant to enter in the Promotion. If online registration is not possible for technical reasons, our support team at enquires@TrytheKit.com is available.

Claims made by fax, telephone, or post will not be accepted. Illegible, incomplete, or altered claim forms or surveys will be deemed void, as will claim forms not completed in accordance with these terms and conditions.

The Participant´s claim will be verified by TrytheKit in accordance with these terms and conditions. Claims are not valid in respect of Qualifying Products that are returned to the Participating Retailer and the Participant exchanges the Qualifying Product or receives a full refund, in which case the Promoter will be entitled to claim back any Cash Back provided.

The Promoter will not process a claim if the Participant does not provide a valid copy of the purchase receipt, the product serial number and image of the serial number and barcode.

In the event that the Participant returns the Qualifying Product to the Participating Retailer, the Participant will not be entitled to claim Cash Back, and any claim will be thereafter dismissed. For the avoidance of doubt this clause does not prohibit in any way the Participant’s right to exercise their applicable statutory or warranty rights.

Any personal data submitted to us will be processed by 3 Legged Thing Limited, its agents or associated group companies for the purpose of administering this Promotion and, if applicable, for marketing purposes – in cases when Participants have opted-in to receive marketing communication from 3 Legged Thing. If Participants do not wish for their contact information to be used for marketing purposes or to enable 3 Legged Thing to contact them in future regarding similar promotions, they should NOT check the relevant “opt-in” box when completing the claim form.

LAW AND JURISDICTION

These terms and conditions and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and will be subject to the non-exclusive jurisdiction of the English courts.

 

DISCLAIMERS

To the fullest extent permitted by law, 3 Legged Thing and TrytheKit shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. However, nothing in these rules shall have the effect of excluding or restricting 3 Legged Thing or TrytheKit liability for personal injury or death caused by the proven negligence of 3 Legged Thing or TrytheKit employees or agents.

3 Legged Thing reserves the right to void, amend, and/or change this promotion at any time without incurring any liability whatsoever.

3 Legged Thing and TrytheKit reserve the right to audit any orders to ensure compliance with these terms and conditions and to request additional information, supporting documents or carry out background checks if deemed necessary. 3 Legged Thing and TrytheKit reserve the right to refuse orders or exclude claims and/or Participants if it suspects that the promotion is being abused in any way 3 Legged Thing decisions in relation to the promotion are final and no correspondence will be entered into.

If any part of these terms and conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful, or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
